This merger corresponds to short-form merger that is specified in the Section 2 of Article 769 of NITTA DuPont Inc.’s company law, and the Section 1 of Article 784 of Rodel Particles, Inc.’s company law respectively. The absorption-type merger defines NITTA DuPont Inc. as a surviving company and Rodel Particles, Inc. as a dissolving company.
